It is merely one thing to copy and paste legislation on to here but to interpret its true meaning and apply it in its intended purpose is by far another. I do always welcome these open discussions on these lil grey areas, especially for our more junior members.

It still does not apply unless the device is operating or detected in an operating manner. Subsection 1 of Rule 225 inheritantly incorperates "A device for preventing the effective use of a speed measuring device", this in itself implies an active device, wich is a prime ingreadient of the offence. Subrule 2 which had to be included back in 1999, was to allow for devices that were concealed or switched off after they were detected.

Most radar detectors are not detected by other technology, it is in fact the behaviour of the driver under certain conditions that allude police to a device being used.
