Fined For Using My Mobile Phone

Yes it annoys the hell out of me police not enforcing the keep left rule, I assume it doesnt help them meet there targets and they wouldnt want to do anything that would actually reduce stress, speeding and accidents on the road.

Every day that goes by I get a little more disenheartened at the system :(

oh and who is you lot? Qlders or everyone???

Not strictly the keep left rule, but I know of someone who was actually booked for "undertaking" - overtaking on the left. It was a few years ago and I can't remember the fine or points, but he did tell me he was booked for it.

Goes to show the lengths some will go to...

No idea, both are offences up here.

Like I said IB, some are pushing it beyond the spirit/original intent of the legislation. That's what sucks the most.

Just a question... Well not so much a question but also a point, technically if you are just holding the phone down near the gear lever then pretty much the point they are proving there is that:

1. It takes your eyes off the road for a few seconds (all it really takes to have a crash)

2. Main focus will be whatever you look at for those few seconds and not the road.

My point/question

If that's the case shouldn't the following be illegal:

- Talking on a cb radio?

- Changing a cd or changing songs, volume adjustment etc. whilst driving?

- Air-con dials etc.

- Cruise control configuration whilst driving

- Having gauges anywhere other than in-front of you

- Checking your speed petrol levels etc.

I'm sure you all get the point... They all take your eyes off the road for a few seconds so I'm sure that checking those is legal then why the hell can they fine you for just looking at a mobile telephone screen to see who's calling.

Also IB, in regards to your post earlier on in the thread, there is a way with checking if you missed the call and it does not require the phone. Network carrier can tell you if you have had a missed call via voice mail etc. Has nothing to do with the end user of the phone but with the network carrier and I highly doubt that any network carrier under any circumstance will change that information, especially for legal matters.

We all know about the whole "the road rules are there for a reason, and that reason is to save lives". Well in my opinion, if they are taking that approach then why don't they make my list earlier on in this post illegal as well.

I lost belief in some police officers ever since I was 16 after I asked a police officer what he could do in terms of bending the road rules and he replied, "I can talk on the phone, drink drive and speed because I'm an officer of the law". After that I asked him, what about off duty? He replied "I'm still a police officer aren't I?". - What makes them any different to any other normal civilian? In the past year in Wollongong there has been 4 police car's ridden off... I have seen police cars that look like they are in no rush (no lights, sirens or any indication to tell anyone to move out of the way) but speeding atleast 20 k's over the speed limit. A few I have followed them all the way to McDonalds, and that is no lie.

Things I will never understand:

- Our taxes pay for these roads.

- Our taxes are partially used for every police officers wage.

- They can break road rules.

- When your house gets burgled, 10k TV was stolen, you obviously call the police... They do nothing.

- People are hanging around in the front of your yard or someone has been making any threats to you, you call the police, first thing they will ask, "Have they done anything yet". Well no, I am calling you to sort something out before something does actually happen. "Well call us back when it's too late and somethings already happened".

- Incident - I was in a nightclub here in Wollongong one night, the club got closed down early due to big fights, police came and everything and told everyone to get out. While outside walking to the car, I saw one guy directed to go one way from one officer and then directed back to where he came from by another officer, he then asked "Which way am I supposed to go, you guys are sending me in circles" then got tackled to the ground by atleast 7 officers.

Our money, we pay tax (Well whoever has a job) that goes into all police officers pockets every 2 weeks, they still have the balls to issue fines for small things, treat us like animals and have some sort of God-like powers.

Sorry, I forgot to add: there is some genuine police officers out there that actually do there job right. But, there is a growing amount of police officers that are just complete asses.

Im sure that's very true, when they find the bloke that stole your car versus the one that gives you a fine for you using your phone while driving. Tickets are not easy to sell as no body wants them.

Some ppl on here need to stop searching for excuses and just cop it sweet. From the my car was better then theirs, to the short on quota day or they just didnt like the look of me. Paranoia and look in the mirror comes to mind.

Perhaps common sense should prevail here. Possibly? Missed call means you were not on the phone, correct? You were not using the phone, you did not ask for the call while you were driving and you chose to ignore it. Hence you did not use your phone. Looking at it is not using it. The Vicroads rule states using the phone's functions, is looking at it using a function, I think not.

Get a stat dec from a JP saying they saw the missed call in your records. Take it to court, represent yourself, get off scott free as you should. Magistrates aren't stupid. Common sense should prevail. Don't just pay it and lose 3 points for someone elses incompetence.
