Just in case there are any legal eagles or warranty experts out there who can offer any advice on getting out of a crappy aftermarket warranty....

Basically - I bought my T last year when it was one year old and had 19000kms on it. I decided to go with the aftermarket warranty that was offered by the Ford dealer I purchased the car from. It isn't a Ford warranty, but an 'Elite Vehicle Protection Program' which offers to cover the same things as the factory warranty for a further 3 years/100 000kms after the factory warranty expires. Underwritten by MotorOne insurance. Cost? $2400

Why did I get it? I do a lot of kms in my job and thought it would be good to have the car covered for as long as possible. Also, probably like a lot of blokes who get into these cars for the first time, I thought 'plenty of power, I'm not wanting to do any mods....' :blink:

Anyway.. after careful reading of some posts on this forum I have come to the conclusion that:

1. I'd be lucky if the warranty is worth the paper it is written on.

2. Due to change is job circumstances I'm not going to be doing nearly the about of kms I thought I would.

3. I've got the bug and want to get at least an edit in the near future.

Also, a couple of things in the warranty fine print worry me.

1. '... your vehicle must not be a prestige or high performance sports model' errr wouldn't this exclude a XR6T?

2. 'The warranty does not commence until the day after the expiration of the factory warranty.' In my case July 2010.

So.... based on the above... do I have a case to argue for a cancellation of the warranty and ask for a refund?? My reading of the situation is that I have a car that probably should have been excluded in the first place as well as the fact that the said warranty does not become valid until next year.

Any advice welcomed.... would love to spend that $2400 on realising some of this car's potential.

I reckon you've just said goodbye to $2400 mate. If the exact wording is "your vehicle must not be... ...a high performance sports model" then they are making it your responsibility to know this before signing up to the warranty

I do not know about your specific warranty, but I had a 2 year extended warranty from Ford underwritten by Swann.

I got rid of the car after 18 months and managed to cash in the extended warranty as it had not commenced. I think it cost me about $1500 and got back $1425 as there was a $75 admin fee.

I would say your chances are quite good as the warranty has not started.

I was suprised how easy it was for me to get my money back and how much of it I got back. Call them up and you may be suprised.

you are probably right senna - but this is why I want to get some sort of legal advice. In my view the Ford dealer who issued this warranty and is the agent for the warranty must know that the xr6t is high performance. Generally it is down to the buyer to 'read the fine print' but if a ford dealer is issuing a product for a ford car which is excluded under the terms of the warranty there might be a good case for the voiding of the warranty... especially since it doesn't take effect until next year.

In the meantime can I warn anyone reading this to be very careful about the 'Elite Vehicle Protection Plan' issued by Range Ford in Perth.

I sell elite warranty on motors be very careful in what you say as to when you speak to them

Mate an FPV is HIPO car not an XR6T as much as we like to think that they are.
