Who's A Lawyer?

Ok so I bought a 2nd hand engine from a company who shall go unnamed for now, not a site sponsor on any forums that I frequent but a large wrecking yard that I found on the web. Here's a bit of the story here http://www.fordxr6turbo.com/forum/index.php?showtopic=70639.

Basically the engine that turned up was not the engine that I bought and I'm finding it very hard to get a refund out of them. I'm up near cairns and they are in NSW. I think a summons or letter/phone call from a lawyer would go a long way. I've been very vague with the details as I know stuff all about the law and don't want to ruin my chances. I'm thinking a call to a lawyer/solicitor to explain all the details might be in order.

What I need is a a legal eagle who has an understanding of cars so I can explain it to them and they can help me sort this out.

So is anyone here a lawyer? or know of a lawyer who knows a lil bit about cars.

If it was advertised as an FG XR6T motor and is in fact a BA/BF motor then I would say you have a case.

As suggested open a dept of fair trading complaint, as they are VERY good against companies that falsely advertise.

Rather than incurring costs with lawyers, get the state government to do the work free,

Mate, if you do call DOFT - just make sure you have your facts straight - just like if you called a lier, sorry lawyer.

We get muppets having a sook to the DOFT every so often - and they just end up dismissing the claims due to the buyers not reading T&C's!

I reckon I got no chance - still haven't got a reciept for the motor and nothing in writing about the deal, it was all over the phone. I think I might reco the engine and sell it, just to make less of a loss.

I always do as it give you more protection.

DOFT are weak unless you have documented evidence. Grab the yellow pages and get a lawyer to write a nasty letter. Will cost you less than $500 and might be enough to let them know you are serious. Further legal action is probably a waste of time given the lack of paperwork but the letter is worth a try.

Well considering that it's fraud, I think you're alright!
