Exact same scenario I was in, she turned across a lane of traffic that was backed up either side of the intersection but the lane I was in was still flowing.

You shouldn't have any worries in that regard as you had right-of-way, and AAMI will not give in easily.

Well got of the phone with the police again and aberrantly that the report has not been finalized and approved by some senior person(forgot the title). The person who took my report was a constable and put the other driver at fault but this is still pending based on the decision of this senior police officer.

Atm AAMI are repairing my car so I spose that it could be worse. I will give this a couple of days to see witch way the report gets finalized

Number two rule in an accident:

Dont ever listen to what the other party has to say about the situation.

The police wont either, no need to worry if you are sure you are in the right.

One thing that may help you get your claim moved up the priority list is to get yourself a solicitor that works pro bono.

How it works is that every time the solicitor contacts the other parties insurer it costs them.

This then forces the other insurer to move on your claim urgently because as we are all await solicitors charge like wounded bulls.

Honestly I think I will give this thing a day or two for the report to get finalized and go from there because atm AAMI are fixing my car with me not at fault and that’s better then nothing.

I worked for AAMi for 5 years, two years in claims.

As long as the claims officer has waived excess at the beginning of the lodgement of the claim and your car is in repairs than you have nothing to worry about. AAMI will attempt recovery from the third party insurer after they have quantfied their loss, (all invoices/cost to them they have paid).

They will not bother you after you get your car back and your happy with it.

In regards to the hire car. Speak to AAMI and forward your invoice to them. As your insurer and advocate they should add it to their proof of loss.

In regards to the quality of the repairs.

AAMI have a very good system in place for dealing with issues after the fact.

Just arrange a re-inspection at the CSC and if you are a persistant bugger, they will usually pay up. Even if you dont deserve the extra work.

Mate don't worry about it, it's her fault. I had a same thing happen to me few years back. Right lane was stopped left was empty and the guy popped in front of me, he's argument was that I was overtaking on the left, well it's not overtaking if there are two lanes. He's insurance sent me a $4500 bill but after sending them a letter explaining what happened they paid me $2000 for damages to my car.

It was a rental car driven by some sort of a church guy from NT, I never thought one of them would try and put the blame on someone else.

And just in case she comes up with a story you were speeding, it doesn't stand even if she's got a withes to confirm, if bystanders could determine speed police wouldn't use radars.
