Big difference when you are street racing on a 4 lane freeway to giving it a belt on a well surfaced, well lit, sparsely populated area.

There are not many options as there is no way you can disprove what they said.

When I was caught I could prove that there was no physical way the police could have caught me from a standing start over the distance they said they covered and still be able to judge my speed. You cant estimate there speed behind you when they decided to give chase, also another officer present also will state what they saw and believe.

Sorry

The police once said I was going to loose my licence for doing a small wheel spin (2 seconds). They said they will summon me to court. They intimidated me in an over the top way. They intimidated my girlfreind more than me, interogated her and made her cry.

In the end they droped everything and didnt even bother with court...

Some hope. Take it to court! With all members have said you should get the 140 penalty

Guys, what would have happened if tuffxr6 admited to doing more than 150 like the cop said? Would he not have to only have given him a fine because he admited it!?

He couldnt have taken his licence because he said one thing, and couldnt lie?

A 'small wheelspin for 2 seconds', you were intimidated by the Police and your girlfriend cried. They dropped everything and didn't even bother with Court.

So what happened........did you get an infringement notice? Did you get a summons for Court or did they just give you a gobful to make sure you realised that what you did was pretty stupid on a public road and they let you go.

If that's the case I think you got off lightly......in fact I think you should be grateful you only got a gobful and had no monetary or license penalty imposed. At the end of the day isn't this the sort of action most people would prefer?

Any inculpatory or exculpatory statement, a confession or admission made at the time only goes to the facts that are presented at Court.

The evidence of what happened is presented to the Court for the Magistrate to judge the veracity of the informant and anything said by the defence.

The simple admission of guilt is not 'vital' piece of evidence that the Crown needs to prove the case. If it was recorded however, it would certainly add weight to the Crown case.

But in court wouldnt it mean enything that the officer said he would only give a fine and then lies and summons you to court.

So what I am hearing is just because this cop says he was doing 150 they believe that just becuase he is a cop? its that right? really? Just becuase he has been in highway patrol for a x amount of years that is evidence and he says he trailed u because he was taught so equasion at highway patrol school. WHAT THE. THAT IS JUST HORSE TURD.

I think that is not good enough.

Daniel,

I have been booked twice on the basis of an estimated speed.

Once (back in '88) I took it to court, the police fabricated the report, and my barrister didn't have a chance.

You may not like it, but it's true.
