I found this interesting , as it could have easily been me getting pinged for this.

I drive the same road form Bris to Gold Coast twice a day and am guilty of occasionally putting the foot down to either get there faster , or after being held up in the right lane by a slow moving vehicle.

I agree the 4 lane, 110 limit is conducive to faster speeds, but you are fighting a losing battle to win this one.

Plead guilty for the 140Kmh , say sorry to the policeman for arguing, respect the judge and you may come out better than arguing it.

The moment you decided not to use your cruise control and race, you run the risk of the penalty. You now need to accept it . ( Yes I know that sucks )

I have seen all manner of undercover police cars, from utes to station wagons. Numerous speed camera's. and the old favourite , the coppers with radar guns sitting in the emergency turn lanes ( they are my favourite , I like to wave at them ... just seem to only use one finger .... lol )

Please post with the outcome of the case, as I may need to use it someday.

You asked for advice about taking this to Court. Perhaps you should have specified you only wanted advice that fits your views.

My advice is that there are a few potential pitfalls in taking this further:

- the cop doesn't have to prove your exact speed. He only has to satisfy the Court beyond reasonable doubt that you were going faster than 150 km/h.

- if the cop estimated your speed by following you at a constant speed of 140 km/h in his car, and he saw you pull away while he was doing it, he can absolutely prove you were going more than 140.

- the cop will say how long he has been working highway patrol, and given the benefit of his vast experience, your car appeared to be travelling more than 10 km/h faster than his. If the Court accepts this, offence proved.

- to get off, you will have to raise a reasonable doubt in the mind of the Court about his views on how much above 140 you were going. I don't think error in his speedo will work, but its worth a try. That only leaves your claim that you and your passenger both looked at the speedo and it only said 140 when you both looked. You need to get that bit sorted so its nice and clear, because the prosecution will grill you with all sorts of questions: were you looking at the speedo the whole time? was your passenger lookng at your speedo the whole time? You have just conceded that you weren't, so the next question would be; so its possible that your car may have been going faster than 140 km/h during the time you weren't looking at the speedo? How can you be so sure, if you weren't looking at it all the time?

Anyway, best of luck. I know I would hate to be without a licence for 6 months.

I need answers to these questions as I have got out of this before.

1. Was there 2 officers in the police car

2. Did they start from a standing start or were they allready moving

3. How long were they behind you

4. Was there car radar equiped.

These are points which I need answered as it has been said it is beyond reasonable doubt.

You can also use the fact that the ADR's state that car manufactures have to build car speedometers to within in 10% of the actual speed they are doing.

I dont believe the copper will be able to prove beyond dobt that your speedo is 100% accurate.

10% of 150 puts you at 135

This sorta thing happened to me a few months back. Me and my mate were having a bit of fun on the freeway I clocked up about 130-140 somewhere around there. After we had out little "squirt" about 2 min later cop car pulls me over and asks how fast I was going and since he didnt have a radar gun or any proof of my speed I told the officer I was doing 100 km/h and if he wants to fine me for speeding without proof ill take the matter to court and we all know without evidence you havent got a case. I did recieve a canary for bald rear tyres but $250 later I was clean.

I hate to say it but tuffxr6 but u were silling for admitting to speeding.

What are u a priest. Street racing??? Pfff you should sell your Xr and buy a sigma. It was probably on a long stretch of highway and he wouldn't have been endangering anyone. Your attitude worries me, cause its the way all the sheep in this country think, believe every peice of bullsh!t u hear on the news and read in the paper!! Its all hysteria just like the fear of terrorism. God this is why morons like braks and scuby get their own way all the time.

My advice with a attitude like urs, go to a mechanic removr your turbo cause u definatly dont need one.

Thought as much. You wern't endangering anyone. Just some power hungry copper abusing his powers. Its a shame to see that some police are like this, riuns their reputation. Next time don't admit anything, you were not racing anyone and you were not speeding, it must of been those cars that just flew past earlier.

1. Yes there was 2 officers in the car

2.Just before we raced I noticed a car about 2 km behind us(which im assuming was the police car)we raced and when I backed off it took about 15 seconds at normal speed when the cop car was behind us with his sirens on tell us to pull over.

3.number 2 should answer this question

4.They displayed no radar equiptment to show how fast I was going,they asked me how fast I was going and when I told them they called me a liar, threated to impound my car if I didnt admitt to exceeding over 150km/h,I told the truth again pleeded my innocence but they still issued me with a $700 fine travelling in exceed of 150km/h and lose of licence for 6 months.

I agree!

You can try to spin it as much as you want, you can get all the bush lawers in the world to tell you what you want to here but you know what you were doing that day.

I'd say your chances if beating it are none and Buckley's. But you can try....that's what the Court system is there for.
