As the topic States, im looking for a lawyer or someone that specialises/has had expierience in car re-birthing. I'm sure people will have lots of questions and it is a very long story so without going into too much detail, I got stung and bought a re-birthed car and it has been taken off me by the nswp. The person it was stolen from was paid out by the insurance policy so it's now owned by the Nrma. I have quite a bit of money in this car including a new engine and at the moment it's looking like I'll loose it all....hence the reason I'm after some solid legal advice. Thanks for any help that anyone can give ! Once this is all sorted hopefully I'll have my car back and I'll have to properly introduce myself ! I did do 3 different checks on the car before purchasing, they all came back clear, when I purcahsed the car I was told it was a replica and not a real typhoon, it had all the driveline and running gear interior/bodykit etc. I assumed it was a re-shell of a written off typhoon. So when I did the checks it came back as a 2006 xt falcon which is what I was told it was when in fact it was a real typhoon that someone had stolen and had the numbers of the 2006 xt put on it. Looking back I shouldnt have touched it without receipts/proof of all the work done. Funny thing hindsight. I had a blue and pink slip done and it passed both, I drove it home and as I was about to ring around for a green slip I got a knock on my door and I had 4 rta inspectors on my door step saying they suspected it was re-birthed and they wanted to check it out, obviously I let them tinking they were nuts and as soon as they plugged the computer in they knew it was in fact the stolen typhoon, it was then taken by trailer and police came etc. It has been with the police since january. Where I failed was that I have seen so many people putting turbo running gear into non-turbo cars and re-shelling written off cars that it never really looked sus to me. I'd like to be aware of common scams out there. This one made me feel unsure.Seller said he'd paid off the Hire Purchase but when I checked on the Personal Properties Securities Register it clearly stated that it was still registered with a "Security Interest" for another 6 months. No owners manual. I did see photocopies of the invoices for servicing (not actual invoices). Wheel lock nuts replaced as well - said the person who took the Owners Manual also took the lock nut key from the glove box. I guess have to ask why would you have your Owners Manual stolen - possibly to help rebirth a stolen FPV F6? And why take the lock nut key? Maybe to come back and steal the wheels (don't think you need lock nut keys anyway - mate of mine had his 4 wheels stolen over night - came out in the morning and found his Expensive Daewoo on bricks!)Also when I checked the PPSR it mentioned 2 different VIC regos for the same VIN number. When I asked the seller about that was told that the plates got stolen at some stage and he had to change the rego. Sounds right - checked on VIC Roads website and the procedure for plates stolen and not recovered is to get new general issue plates with new numbers. But the dates didn't line up with the photocopy of the Police record shown me (which did not mention what was stolen just the value of what was stolen which I thought odd) and the date when changes were made in the PPSR (changes to record entries in the PPSR - PPSR showed the rego changing about 6 months earlier).Underneath the rear of the car the diff drive line bolts were all shiny new (like bright silver whereas everything around them was grimy dirt) and when I asked if any mechanical work had been done on the drive-line the answer was no. That was all legit I think - all the vehicle's paper work I saw referred to that address as the vehicle was registered under the business name.No Owners Manual was disappointing. They're like official papers or birth certificate in a way - as they record where you bought the car from - who the first owner was. And of course - the plastic folder also contains the Warranty Card with all the official rubber stamps of each time the car was serviced and at what ODO recording. Yeah when I bought my BA T - before I handed over the bank cheque - I made sure the VIC Roads register at the time indicated it was all clear of any encumberances.
