Cheeky farker! He added to the contract a special condition that I'm aware that the patio isn't council approved and accept as is...

Building inspector is coming first thing Monday morning, so will ask him if it'll be easy enough to get retrospectively approved...otherwise fark that! Can't do anything until then anyway, but get farked if I'm signing that condition if it'll be a problem to get approved!

Dont sign. If its exceeds the allowable coverage you will be made to pull it down. It will NOT get approved. That is probably the reason it wasnt put in for approval in the first place.

You can check the council's website for details on various development approvals.

 

With that information on hand you can measure the patio and see if it will pass.

 

Another option is to not bother with that and change your offer to 20 to 30k less.

 

But yeah, keep in mind that the value of the property hinges partly on whether the patio will be approved or not. 

 

Realistically don't sign any contract until you have another valuation that includes the value of the property minus the patio, including the cost of removal and said contract reflects that. 

 

Are you willing to still buy the property with a decent part of it missing?

 

Don't rush mate, there's more than one house out there that suits your needs.

 

Hit up realestate dot com and start looking.

Well I originally sent him a signed contract and he's sent it back with those bits added in, but I haven't initialed his amendments yet. I'll wait and see what the building inspector says, but if it can't be approved then I'll walk away.
